These Terms & Conditions apply to purchases made through the Cottura Design online shop. Please read them carefully before placing an order.

By placing an order through our website, you agree to these Terms & Conditions.

Nothing in these terms affects your statutory rights as a consumer.

2. Products

We take reasonable care to ensure that product descriptions, specifications, images and other information displayed on our website are accurate.

Product images are provided for illustrative purposes and the appearance of products may vary slightly depending on photography, screen settings or manufacturer updates.

Manufacturers may occasionally make minor changes to product specifications or appearance without prior notice, provided these changes do not materially affect the product.

Please check product dimensions, specifications and compatibility carefully before ordering.

3. Product Availability

All products are subject to availability.

If a product becomes unavailable after you have placed an order, we will contact you as soon as reasonably possible.

Where we are unable to supply a product, we may cancel the affected item or order and provide a full refund for any amount already paid for that item.

4. Prices

Prices displayed on our website are shown in Pounds Sterling (£).

Unless clearly stated otherwise, prices include VAT at the applicable rate.

Delivery charges, where applicable, will be shown during checkout before you place your order.

We reserve the right to change our prices at any time. Any price change will not affect an order that we have already accepted.

5. Pricing and Website Errors

We take reasonable care to ensure that prices and product information displayed on our website are correct.

If we discover an obvious pricing, description or technical error relating to an order, we will contact you as soon as reasonably possible.

Where appropriate, you will be given the opportunity to proceed at the correct price or cancel the affected order and receive a full refund.

6. Placing an Order

When you place an order through our website, you are making an offer to purchase the products in your basket.

After placing your order, you should receive an order acknowledgement by email. This confirms that we have received your order but does not necessarily mean that we have accepted it.

A contract between you and Cottura Design is formed when we confirm that your order has been accepted or the goods are dispatched, whichever occurs first.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including where:

  • A product is unavailable

  • Payment cannot be authorised

  • We identify an obvious pricing or product information error

  • We reasonably suspect fraudulent activity

  • We are unable to deliver to the address supplied

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.

7. Payment

Payment must be made using one of the payment methods available during checkout.

You confirm that you are authorised to use the payment method provided.

Payments may be processed on our behalf by third-party payment providers. We do not normally receive or store your complete payment card details.

8. Delivery

Available delivery options and applicable charges will be displayed during checkout where appropriate.

Please ensure that the delivery address and contact information supplied with your order are accurate.

Any delivery dates or times provided are estimates unless we have expressly agreed otherwise.

We will take reasonable steps to deliver your order within the stated timeframe and in accordance with applicable consumer law.

For larger appliances, you may need to ensure that suitable access is available for delivery. Please check doorways, staircases, corridors and other access restrictions before ordering.

We are not responsible for a failed delivery caused by incorrect information supplied by you or where reasonable access for delivery has not been provided.

This does not affect your statutory rights.

9. Checking Your Delivery

Please inspect your order as soon as reasonably possible after delivery.

If you notice that an item is damaged, incorrect or appears to be missing, please contact us as soon as possible so that we can investigate and resolve the issue.

Where practical, photographs of damaged products and packaging may assist us in dealing with a delivery claim.

10. Cancelling Your Order

Consumers purchasing products online will normally have a legal right to change their mind and cancel their purchase within 14 days of receiving the goods.

If you wish to cancel an order, please contact us and clearly tell us that you wish to exercise your right to cancel.

Once you have notified us, the goods must normally be returned within a further 14 days.

Nothing in these Terms & Conditions limits your statutory cancellation rights.

11. Returns and Refunds

Returns, cancellations and refunds are handled in accordance with our Refunds & Returns Policy and applicable UK consumer law.

Where you exercise your statutory right to cancel, you may be responsible for the direct cost of returning the goods.

Large appliances may require specialist transportation and the cost of returning them can therefore be higher than the cost of returning a standard parcel.

Please contact us before returning a product so that we can provide appropriate return instructions.

12. Faulty Goods

Products supplied by Cottura Design must be as described, fit for purpose and of satisfactory quality as required by applicable UK consumer law.

If a product is faulty, damaged or not as described, please contact us.

Depending on the circumstances and your statutory rights, you may be entitled to a repair, replacement, price reduction or refund.

Nothing in these terms limits your rights under the Consumer Rights Act 2015.

13. Manufacturer Warranties

Some products may include a manufacturer’s guarantee or warranty.

The duration and conditions of manufacturer warranties vary between products and manufacturers.

A manufacturer’s warranty is provided in addition to your statutory consumer rights and does not replace or restrict those rights.

If an installed appliance develops a fault, please contact us before arranging removal or repair, as the manufacturer may need to inspect the appliance.

14. Installation

Unless installation is expressly included as part of the product or service purchased, products sold through our online shop are supplied on a supply-only basis.

You are responsible for arranging appropriate installation where required.

Electrical, gas, plumbing and other specialist installation work should be carried out by suitably qualified persons where required.

Cottura Design is not responsible for damage caused by incorrect installation, misuse or failure to follow the manufacturer’s installation and operating instructions.

Nothing in this section excludes liability that cannot legally be excluded.

15. Your Responsibilities

You are responsible for ensuring that:

  • The information supplied when placing your order is accurate

  • The product is suitable for your intended use

  • Product dimensions are suitable for the intended location

  • Suitable access is available for delivery

  • Products are installed and used in accordance with manufacturer instructions

  • Any installation requiring qualified tradespeople is undertaken appropriately

16. Our Liability

We do not exclude or limit liability where it would be unlawful to do so.

This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your statutory rights in relation to the products we supply.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

If you are purchasing as a consumer, we supply products for private and domestic use. We are not responsible for business losses, including loss of profits, revenue, business opportunities or business interruption arising from consumer purchases.

17. Website Use

You may use our website for lawful purposes and to browse and purchase products.

You must not misuse the website, attempt to gain unauthorised access to it, introduce malicious software or use the website in a way that could damage or impair its operation.

18. Intellectual Property

Unless otherwise stated, the content of the Cottura Design website, including text, graphics, branding, design elements and original imagery, belongs to Cottura Design or is used with permission from the relevant rights holder.

Manufacturer names, trademarks, product photographs and other intellectual property remain the property of their respective owners.

Website content must not be reproduced or used commercially without appropriate permission.

We process personal information in accordance with our Privacy Policy.

Please refer to our Privacy Policy for information about what personal information we collect, how we use it, how long it may be retained and your data protection rights.

20. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our business, website, products or applicable law.

The Terms & Conditions applying to your purchase will normally be those in force when your order was placed.

21. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory protections provided by the laws applicable where you live.

Nothing in these terms affects any statutory rights you may have regarding where legal proceedings can be brought.
